Yesterday, HB 372 – a bill that would legalize, regulate, and tax cannabis sales in the state – fell short of the needed 25 votes. Notably, the bill sponsor, Rep. Ed Osienski (D), changed his vote from yes to no, which will allow him to have the bill reconsidered before the legislative session ends on June 30. The final vote count was 23-15 with two absences (one of whom is a cosponsor of the bill).

Today, two separate cannabis legalization bills were passed in committee!

Today, Delaware’s House Health and Human Development Committee voted 10-4 in favor of HB 305, a bill to legalize, tax, and regulate cannabis for adults 21 and older. It now moves to the House Appropriations Committee for consideration before heading to the House floor.

Last year, two Delaware House committees approved HB 150 — a bill to legalize, tax, and regulate cannabis for adults. However, the legislature adjourned without further action on the bill. Rep. Ed Osienski, sponsor of HB 150, plans to introduce a revised version of the bill again, with the aim of passing it this year.

The bill was cleared and scheduled for a House floor vote on June 10, but unfortunately, that vote was postponed to allow more time to work on amendments. The legislature adjourns today. However, since the General Assembly holds a two-year session, the bill will pick up where it left off in January 2022.

Exciting news! Today, Rep. Ed Osienski introduced his highly anticipated legalization bill — HB 150. The bill would legalize possession of up to one ounce of cannabis for adults 21 and older, allow for mandatory expungement of past cannabis possession convictions, and promote equity and inclusion in the legal industry from communities disproportionately impacted by cannabis prohibition.
