The Illinois House and Senate have passed SB 3222, which would make several changes to Illinois’ cannabis and hemp laws, including doubling cannabis possession limits. The bill now heads to Gov. J.B. Pritzker for his consideration.
Under SB 3222, Illinois residents could possess up to 60 grams of flower, 10 grams of concentrates, and infused products with up to 1,000 mg of THC. All of these are double the current limits. Non-residents’ limits would also be doubled, to up to 30 grams of flower, five grams of concentrate, and infused products with up to 500 milligrams of THC.
Among other changes, the bill would also:
- allow adult-use retailers to opt in to become medical cannabis dispensaries, allowing patients to purchase cannabis without paying a “sin tax”
- expand eligibility for automatic expungement from possession of up to 30 grams to possession of up to 60 grams
- allow drive-through cannabis and curbside pick up
- allow craft cannabis operators to expand canopy from 5,000 to 14,000 square feet
- limit final hemp cannabinoid products to 0.4 milligrams of THC per container, mirroring the change that is scheduled to take place under federal law on November 12, 2026
- allow telehealth for medical cannabis certifications
- allow hemp license holders to enter the cannabis market
- impose new regulatory requirements on consumable hemp
- waive or reduce renewal fees for small cannabis operators
- mandate that social equity transporters transport 50% of cannabis
