Ariz.: Last chance for lawmakers to amend or kill bill criminalizing cannabis smoking on private property!

The full Arizona House of Representatives is expected to vote soon on a vague, overly broad bill that, in some cases, recriminalizes cannabis smoking — even on private property! 

If you live in Arizona, ask your representative to oppose this draconian bill. 

If passed, SB 1725 would deem “excessive” cannabis smoke and odor a private and criminal nuisance, including at private residences. Cannabis odors would be deemed excessive if they can be detected (even faintly) for more than 30 minutes at a time from another property, or three times within 30 days. 

The vague “public nuisance” language carries a misdemeanor penalty with up to four months in jail. 

Singling out cannabis smoke as the only smell with its own nuisance standard is absurd, especially given that cannabis is a medicine for many people. This outrageous bill would not apply to tobacco smoke, which has repeatedly been shown to be more harmful to one's health. 

In 2020, 60% of voters passed Prop 207, legalizing cannabis consumption and imposing a civil fine for public cannabis smoking. It is absurd and unfair for lawmakers to override the will of a supermajority of voters.
