Oklahoma legislature attempting to raise medical cannabis taxes!

The Oklahoma Legislature has convened for its 2026 session. While the governor's threats to the medical cannabis program appear unlikely to materialize, we are seeing attempts to overly restrict the program. 

One alarming bill, HB 3314, would allow local municipalities to have referendums to add up to a 15% local "public service impact" tax on medical cannabis products. Currently, patients are paying a 7% excise tax, 4.5% state tax, and some municipalities levy an additional tax. If passed, this could more than double taxes for medical cannabis patients.  

If you live in Oklahoma, tell your legislators to say NO to new medical cannabis taxes.

In his final State of the State address, Gov. Kevin Stitt (R) attacked Oklahoma's medical cannabis program and called for the legislature to send another ballot question to voters to "shut it down." The governor used the same inflammatory rhetoric in his address in 2022. After several days, both House and Senate leadership admitted there was no appetite for such a move. 

But other bills are being considered to further restrict the voter-enacted program. Legislation has been introduced to limit employment protections (HB3127), cap the number of licenses (HB3144), tighten regulation on edible products (HB4454), and lower patient allotments of cannabis (SB320).
