Mississippi legislature convened, let’s make cannabis policy a priority!

After the state Supreme Court prevented Mississippi’s 2020 voter-enacted medical cannabis law from taking effect, the Legislature and governor enacted a more restrictive medical cannabis program that took effect in 2023. Over 66,000 patients were participating in the program as of the end of 2025, but the law remains more restrictive than in many states. 

Mississippi’s 2026 legislative session is underway, and there are multiple medical cannabis bills proposed:

  • HB 1152 would expand the number of conditions covered under the medical cannabis program. 
  • HB 895 would eliminate the need for follow-up visits with a recommending physician within one year and extend the state ID card from 1 to 2 years. 
  • HB 894 would remove potency caps for many medical cannabis products.

The Mississippi Constitution creates a right to the ballot initiative process, but the law implementing it is now mathematically impossible to comply with. Several legislative attempts failed to reinstate the ballot initiative process during the last four sessions. Being a constitutionally mandated right for Mississippi, there are a series of bills that could potentially reinstate this fundamental right.
