Court Upholds Temporary Ban on Florida Welfare Drug Testing

Earlier today, the 11th U.S. Circuit Court of Appeals upheld a lower court ruling that temporarily halted the enforcement of a Florida law requiring that all welfare recipients be drug testedUrine Sample in order to receive benefits.

We have addressed this issue in the past on this blog, and it is good to see the 11th Circuit supporting the lower court’s decision. Drug testing in this fashion is an invasion of privacy, and in most cases ends up costing the taxpayers far more than is saved by denying benefits to the very few people who test positive.

    So glad Adam that you are willing to give up peoples 4th amendment rights and yours as well. The argument shouldn’t be that people on welfare need to be drug tested “cause how can they get a job if they can’t pass a drug test” THE argument should be that why do you need to submit to a drug test to get a job.

    I dis agree with this. cost to much money foe tax payers, also against our rights of privacy. Legalize marijuana and thats away to make money.

    So, Adam, are you saying that all welfare recipients who have kids use drugs? Also, I know a man whose dentist gave prescribed to him something for pain. He was taking it until his appt. to go get it pulled. In the mean time he had a dr.s appt. and gave him a blood test. It showed opiates. From the scrip the dentist had him on. Lost his Medicaid. Thank God he got it back after further investigation proved he was on it legitimately and a dr. had prescribed it. Wonder how much the State paid for all that testing? Some people just can’t win for losing. Others just don’t care, as long as you are proved unworthy of the benefits you are getting. You think you are so well off that you will never have to ask for State assistance for anything? Thank God now, that you don’t. Because things change, and in just a matter of time, something called Karma enters your life and affects you in ways you would never dreamed possible. Take Care. Peace.

    If I have to take a drug test to get a job, people on welfare should have to take one in order to get their free money from my taxes. I am a medical marijuana user for sciatic nerve eruptions, but most of the people I know that are on welfare know how to work the system. It just makes sense.

    @Jarett you are quite the hypocrite. You have clearly accepted the medicinal quality of marijuana, but poor people should die (i.e. starve) for using their preferred medicine. But, paying for clinical drugs that have more side effects, including death, are acceptable. Yet, if a person is so poor that they can’t even buy marijuana, and happens to have a friend who gifts them any marijuana (i.e. causes a failed urinalysis); it is then perceived to mean that person (who smoked the free marijuana) must starve too. Regardless of how a person obtains marijuana; you either agree or disagree with its use as medicine. @Adam: people with kids aren’t allowed to have medicine? These diatribes from mindless potheads (abusers) is why the intellectuals (users) have a hard time convincing politicians to loosen the Federal abuse of power, that is regulation of anything a person chooses to consume in their own body. As far as tax dollars wasted on food is a disgusting and inhumane argument; especially, when many times the money spent of food stamps is wasted on political galas, inaugural balls, and foreign waste. This is exactly why America is going to Hell in a hand basket.

    drug test anyone who takes tax payer money for any reason- employed by government, elected, retired and receiving benefits, on every level of government, all of them. The pay the ” public servants” get is far more than we spend on all public assistance programs combined…
    So, how many of our public” employees” do you think would fail one? Include alcohol, too.

    Being poor and needing assistance is not probable cause. A judge will not issue a search warrent just because you are poor or need assistance.
    Pee testing does nothing to stop drug use or abuse. It’s just anoher way people make money off of other people’s misery!

    Drug testing is for piss Nazis. It doesn’t matter if they are wrong or have made a mistake. They just need a tool as an excuse to deny you anything. The judge is not human. It is more like using the magic 8 ball.

    Medicinal marijuana should not be included in the test, in fact hemp should be legal.

    If you think it is ok to test for Marijuana before giving welfare, just wait until they begin testing for SUGAR abuse. Sugar abuse kills more people in the usa every year than all illegal drugs combined. Are you prepared to set the table for the Government to lock you up, take away your food when needed just because you had a candybar? If you give the Government a tool you better bve prepared for a lawyer to twist it at your expense down the road. Tread carefully when violating our privacy please!

    the government is continuosly stripping the rights of poor impoverished people such to the point of a contrived ridiculous application of damning rules to keep you under a curb of humiliationin in illinois, you only get 75.00 per month per person this alowwance is for disabled individuals whose income is 8,400 a year
    for that degrading amt. but what would happen if i am severly disabled and in pain and depressed because i am poor and disabled what if i tested positive for marijuana ?
