War on Medical Marijuana Patients Continues in San Diego
I’ve recently been corresponding with a medical marijuana patient and Navy veteran, Eugene Davidovich, who was recently arrested in a particularly slimy undercover sting operation. Eugene, a member of a San Diego medical marijuana collective, was contacted by an undercover cop posing as a registered, licensed medical marijuana patient who asked for his help obtaining his medicine.

Prosecutors argue that Eugene violated the law in providing medical marijuana to the undercover cop – even though the cop presented him with documentation verifying his status as a licensed medical marijuana patient. They even insinuate that Eugene’s motive was profit and not compassion.
It appears that what’s really happening is that prosecutors are taking advantage of vagaries in California’s medical marijuana law to persecute patients and caregivers who are doing their best to take care of themselves and stay within the law.

Every attempt made to date by collectives and coops to follow the law in San Diego has resulted in prosecutions or collectives having to operate so deeply underground and under such intense daily fear and pressure, that the potential public benefit they could be bringing to the community and to patients is stifled by this environment of fear.

That is disgusting. Cops like that are slimy and a disgrace to this fine nation.
I just dont get how they can sleep at night. They are supposed to be protecting people from those who would do them harm and they waste taxpayer money and time to pursue patients.
I can vaguely understand how, if you are severely mis-informed, you could make the case for going after recreational users. But how in the hell can someone justify going after a medical patient?!?!?!

Nothing in the law allows the police to lie to doctors to falsely obtain prescriptions. The cop committed medical fraud and obtained a medical recommendation from a doctor.

Not true. Cops are there to protect the State from those who violate State laws. Never in recent history have the cops protected an individual’s right. That would be a civil matter and the police do not get involved.
The cops actions in this story are ridiculous and one reason I left California Uber Alles.

What is wrong with San Diego? Really?
Bad cops give ALL cops a bad reputation. The good ones out there should say something about this in public. Otherwise, they’re just as guilty for looking the other way when this crap goes down.
This is just the tip of the iceberg here in San Diego County. Our vindictive county board of supervisors has fought the state medical marijuana laws all the way to the federal supreme court (and lost). They have continually directed the DA to deceptively go after every collective, head shop and medical cannabis user they can – including those in full compliance with state law. I would not want to be at the receiving end of their karma.
I moved away from San Diego, my birthplace, in 1987, largely due to horrible experiences with the corrupt SDPD involving being busted for weed that I never had. It just showed up in court. I now live in a tiny town in WA, and never looked back.
These cops truly believe they are doing good by arresting these people, thats sad! One day they may find out that they have been fighting this war based on lies and then we will see if they can sleep or not. Knowing that they spent their career arresting nonviolent drug users over lies and corruption, man they may just quit! Wonder if that will be considered War Crimes when prohibition ends? I think the top dogs that have lied and kept lying in the face of truth,they shoud be locked up for their lies!

This is all a simple matter of the DEA staying employed by coming up with idiotic approaches to bust patients. On the same subject, opponents (specifically in this case the police) are following a course of action that says opponents are still upset that someone is using marijuana.
Its funny, I’ve been watching many many blogs on the internet. Many months ago people didn’t seem to notice that our freedom is being stolen. Now its a whole different story….people are waking up. We MUST defend this great land against all enemies…Foriegn and DOMESTIC!
This is seriously sad, why would you want to arrest a patient in need of medical treatment, it’s completely ridiculous. I really don’t have much to say about this, I can’t believe it.
I dont even know what to say, it saddes me to hear about the evil and ignorance of our goverment and spends Billions of dollars saying that they are trying to protect us and watch over us, when from behind the curtins they prosecuting people for false felony and put them in prison! Is it not ironic that our government makes accusations that motives for selling medical cannabis is profit-driven and not compassionate? It is not only irony, but sheer hypocrisy. Why are state medical marijuana bills forced to include a “not for profit” policy? What is wrong with making profit? What is the harm, seriously? Funny, isn’t the pharmaceutical industry a multi TRILLION dollar industry? What about millions of people denied healthcare as well, just because they have no money or insurance? So who are the ones being non-compassionate and profit driven?
My question is and always has been is “What’s the cage for?” Also, I’ll bet that really ticks members of LEAP off. It make them ALL look bad. To the police who insist…PLEASE lay off the sick people and get the “caregivers” who do not follow the rules and turn it into a dealing type situation by charging regular street prices to really sick people. $300-$400 an OZ. is IMPOSSIBLE!!! for me per month at a recommended dose of 7grams a day for the treatment of Multiple Sclerosis.

Well that settles that, I was considering joining a co-op but now I have changed my mind. As a Medical Patient I find buying from a dealer as deplorable as buying from a club. The Poor in America can’t trust the black market or the Police. I hope someday that they get to have a big slice of the shit sandwich we are all eating!!!!

According to CA Senate Bill 420-11362.81 A person shall be subject to the following penalties: Imprisonment in county jail for no more than one year, or a fine not to exceed $1000 or both for fraudulantly representing a medical condition to a doctor.
So let me see if I got this right. It’s ok for law enforcement to break the law in order to arrest and procecute someone who is following the law. Also, since when does the DA get to decide that a law is invalid. When a DA starts having law abiding citizens arrested just because she doesn’t like the law, you start down the road toward police state and the end to freedom and civel liberties. I believe that our founding fathers would be disgusted at what our country has turned into, and at the fact that the people who are entrusted with protecting the people in fact rarely protect or help anyone and spend most of their time going after easy targets to boost their arrest numbers, while violent criminals usually get away with what ever they want. Laws are supposed to protect people from other people, not themselves.
San Diego county is protecting their buddies south of the border. It is just a matter of time until one of them gets caught. Then we will have proof that it is corruption talking, not just prohibitionist pinheads. There is no doubt in my mind that officials are being payed big bucks by Latin cartels too eliminate legal Cannabis in S.D.

I just wanna know when people are gonna take back the state. Im not talking about violence (even though almost every time the US government does stuff like this it ends in violence, i.e. prohibition on alcohol and Al Capone.) Anyways, Im not talking about the violence, isnt there still such a thing as a citizens arrest? I would get a group of people and go find this guy, search his ass for illegal documents for medical MJ, and take his ass to jail. Americans have sat by watching for tooo long. If a jury in Illinois can nullify a law because they find it unlawful and if the US Supreme Court says that all state law overrides federal, then WE THE PEOPLE have our power back. Now if some people had a backbone, including this peice of shit cop. He probably kicked ol Eugene in the face after Eugene laid down on the ground in FEAR of being shot, killed, and even worse, busted.

I also would like SOMEONE to PROVE where there is a law stating that federal law overrides state law. You can’t find the law anywhere. The thing is the law says that the STATES have power over the federal government. Its in the damn constitution, remember that little thingie written by those guys from europe? Is the US constitution now void? See the tenth amendment. What is infuriating to me is that this is a black and white issue. The government has created this massive gray area to blind people from seeing the truth so they can keep their federal funding and keep robbing dispensaries. The law is the law, the constitution is to always be honored, but it has not been at all. It has been used as toilet paper by the DEA and federal government. The path our government is going is not a good one at all. Every society or dynasty always collapses at some point. The US government will collapse some day, but it may not be in our lifetimes, but it will happen, as a result of their dishonesty and disloyalty to its people, as well as greed. We the people have the power, not the government and they know it.
well it appears that our mr.obama is a liar of sorts as his new drug zar said this would no longer happen. and the cop involved here needs to be charged with fraudulantly obtaining a medical marijuana permit. to do others mental and physical harm. the name POLICE explains it all they are parasites hench LICE in the name. its a warning for people.so they can stay parasite free.
