Wal-Mart Fires Cancer Patient for Legally Using Medical Marijuana
Joseph Casias, 29, has sinus cancer and an inoperable brain tumor.
Despite his condition, he has dutifully gone to work every day for the last five years at a Wal-Mart in Battle Creek, Michigan, where in 2008 he was named Associate of the Year.
Casias is also a legal medical marijuana patient under Michigan state law. He uses marijuana with the recommendation of his doctor to relieve the effects of cancer.
But Wal-Mart, the world’s largest public corporation, has no sympathy for his condition or regard for Michigan’s state law. Last November, Wal-Mart fired Casias because he tested positive for marijuana during a routine drug screening.
Here’s what a Wal-Mart spokesman had to say:
“In states, such as Michigan, where prescriptions for marijuana can be obtained, an employer can still enforce a policy that requires termination of employment following a positive drug screen. We believe our policy complies with the law and we support decisions based on the policy.”
To add insult to injury, Wal-Mart is now challenging Casias’ eligibility for unemployment. Simply outrageous. This is the thanks he gets for showing up to work and doing his job for the last five years, despite being stricken with a potentially life-threatening illness. “I gave them everything,” Casias told a local news outlet. “One-hundred-ten percent every day. Anything they asked me to do I did. More than they asked me to do. Twelve to 14 hours a day.”
Sadly, the dilemma facing medical marijuana patients who still have no legal protection from being fired is nothing new.

We do have a long way to go. It really makes me angry when i see these companies firing their best employees over cannabis, because some policy says they can do this. Wallmart will never get a dime from me again. I wonder if every WallMart employee was fired for any kind of prescribed drug. I smell one hell of a lawsuit. Until the lawa for marijuana are re-written and a drug free policy is implemented for employers that excludes medical marijuana from the list of drugs you can get fired for.suing Walmart won’t get you anywhere.And as noted here before,this economical depression has most people living on such a tight budget that most people shop at Walmart because they have the

The statement they made about it being allowed to fire people, and policy to fire people that test positive made me so upset. Even Wal-mart should know that just because something is policy, there are always exceptions that can be made. This is about people, and it is the right thing to do. Normally, I’m a huge fan of Wal-Mart. On a day-to-day basis I think they get a bad rap. In general, they make life much more affordable–which is really important for low-income people but makes them an easy target for better-off who derides shopping in stores that are “cheap” or “low-class.” I’m not alone in my opinion. The Democratic economist Jason Furman has calculated how much Wal-Mart has done for poor people by single-handedly keeping inflation down and said, explicitly, that very few of the policies that he advocates can do as much good for poor people in their day-to-day lives. (Furman works for the Obama administration.)
All of this is just to say that I don’t bash Wal-Mart for its own sake.
And yet, this behavior is intolerable, inhumane, and indecent. I hope that the executives of Wal-Mart will realize that they is a public relations disaster for them, a failure of common sense, and a real black mark against their claim to be good corporate citizens.
They should understand that 80% of Americans are in favor of Medical Marijuana. Whatver you think about the broader issue of cannabis, we all believe that the USA should not be in the business of imprisoning, prosecuting, or discriminating against sick people.
Rehire Casias and apologize for your mistake, Wal-Mart. Only then will we, the regular Americans who shop at your store, regain our respect for you.

This is unbelievable. They sell the two most harmful and destructive drugs in the world based on lives lost, (alcohol and tobacco) not including the prescription drugs, yet they fire a man with cancer who has worked hard for them day and night because of the medicine he uses for his medical condition? DO they test for ANY prescription drugs? What about prozac? Do they even look for that? People die from that stuff, and when they quit taking it, they have been known to kill others as well. You might want to check out a Frontline episode on them and why they are responsible for so much of our economic woes. The urine test for marijuana WILL NOT tell you if you are impared at the time of the test.The test checks for metabolites,which is a byproduct of the TCH in marijuana, that is produced in your body after smoking/consuming the harmless weed.The test will tell you if you have used pot within the last several weeks at best. Failure of a urine test IN NO WAY proves, that he was HIGH on the job. This is an outrage and an infringement on OUR personal freedoms!! Where is OUR DOMESTIC TRANQUILLITY!!!!!!!!!!!!!!!

To start with, I have been a loyal customer for 34yrs. I can’t even explain the amount of childhood and adult memories I have had in a Walmart. Many I will never forget. I was good friends with Sam Walton’s brother-in-law and met Sam and his wife. So my loyalty has ran very deep.
Now the reason for my letter. This week I read about Joseph Casias 29 cancer patient from Michigan. All the stories around this makes me believe that Walmart not only don’t want medical marijuana patients to work there but don’t want their business either.
Now in the state of Colorado there will be over 100,000 medical marijuana patients by May of this year. I won’t be able to convince all of them, of course, but I will dedicate every second I have to boycott you and spread the word about what is really going on behind that smillie face in the comercials.
I am asking to please reconsider your policy on terminating the terminally ill people who helped get YOU were YOU are today. And until YOU do change your decision against Joseph Casias 29, SINUS CANCER PATIENT WHO HAS AN INOPERABLE BRAIN TUMOR, I will not be shopping at any of YOUR stores.

this is only one example of that tops a mountain of others that truly need addressed.
I already don’t shop at WalMart for lots of reasons. However, calling for a boycott of a major corporation should be based on something more than unsubstantiated or undocumented claims of one person.
The reality is that people lie all the time over much lesser matters. How many phony fundraisers for dying children have recently been exposed as scams?
Has anyone seen a statement from a physician of the alleged five year old diagnosis of cancer and the prescription for marijuana?
My wife and I drove the 100+ miles from our home to join the 100+ people who showed up to the protest rally in front of the Battle Creek WalMart. It was difficult – pain wise – as we are both disabled. But, we were happy and honored to be there for this young man. Now, he needs a high-powered law firm like Geoffrey Fieger to take up his cause. Enough is enough. Joe is the reason why we have this law! What WalMart did to him amounts to simple murder as they are killing this poor young man by firing him and now challenging his unemployment benefits. Tomorrow I will begin my quest to find out EXACTLY who it was that fired him from that Battle Creek store. Stay tuned. This isn’t over…not by a long shot!
Has anyone checked on whether Wal-Mart, by firing this guy, violates the Americans with Disabilities Act, a federal law which is supposed to come down hard on businesses that discriminate based on disabilities? Someone, preferably an ADA attorney in Michigan, should really investigate whether firing someone because of taking legally prescribed medication for a DISABILITY (yes, cancer is a disability) is considered a violation of the ADA. If this is the case, I could see also a personal action against the manager that fired him for a violation of his constitutional rights to be free from discrimination based on his disability.
Wal-mart fired this employee because they do not want him on their group health insurance plan. Has everything to do with his medical bills and nothing to do with the medical marijuana. Its just an excuse. Same story with denying him unemployment, they are simply greedy.

As a college student. I have just turned in an argumenative paper on the legalization of MM. I received a call from a family member who told me of this situation and I was really SHOCKED! This case is a rediculous one to say the least….are you friggin serious??? Walmart should be ashamed! My phone number was REQUIRED which in itself is against the ADA laws because I am profoundly deaf and do not have a phone. I did point out to Walmart that that leaves them currently in violation of US law.
I went to print out a copy just for myself and the entire page and message I had filled in just flew away. Apparently they have hidden rules they don’t bother to mention and it’s either their way or the highway.
Dear God, let that chap who was using legal mj to help with his sinus cancer and a brain tumor soon find a job with a compassionate employer. Right now Walmart has made it very easy for me to just keep driving by their junky stuff and go to more ethical places to spend my few dollars.

The point is that Walmart is upset because they can-not YET control the sale of medical marijuana.
Until they can figure out a way to get the rights and do this cheaper than anyone else, they will never change their policies on this issue.
Unfortunately, this suffering gentleman/ex employee is caught in the back wash of big business.
You see, WalMart sets the pricing on their vendors products and not the other way around. In other words, this is how they are so successful in removing their competition.
Walmart has systematically gained strength world wide by undercutting competition and gaining consumer support. If a vendor does not submit to WalMart purchase pricing then WalMat boycotts that product or company by not carrying the items or products. Most vendors tuck their tails between their legs, give in or go broke and out of business because their product can not be sold on a global market at a low and appealing price to the masses of consumers.
These are very ingenius tatics by Walmart if you ask me.
BTW…my mother worked until see died of brain cancer for a northern Michigan Walmart. She was not on medical mj but, I did feel in the end she was just another employee chewed up and spit out of the corporate machine.
Many of corporations are going to these cut-throat tactics and have the attitude that if you want a paycheck then YOU must follow the rules and jump the hoops. Hey, there is a line of people waiting for your job, step out of the way if you don’t want it or are unwilling to conform to our needs. Very True I’m afraid to say.
We can all be mad and boycott Walmart but during our bad economic times very difficult to convince the world masses and ask them to stop saving $$ and shop elsewhere.
Nothing will change until a smarter person with a whole lot of capital comes along and out does WalMart. Hopefully this new company will be more sympathetic to their workers, but I doubt it.

This should not come as any surprise as Wal-Mart is just another major corporation that does not respect anyone or anything, so why
would they care even care about their employees? Has anyone been to Wal-Mart recently? Are they just beating these people relentlessly in the break room? Their workers look miserable and this is one of the riches companies in the world. They should give their employees a joint before work just so they can get through another day of working in such a horrible environment. This employee should just grow marijuana and sell it and he will probably make 1,000 times as much as their cheap asses pay anyways. Thank you, WalMart, for providing so many people with work, for giving the money from an associate’s death to the associate’s family (the people the associate chooses during benefits open enrollment), for partnering with Blue Cross to give associates quality insurance options, for providing annual raises when many companies put a freeze on raises, for hiring full-time associates when there is a need, for providing a family-like community of associates who pull together when disasters happen, for not being unionized and making associates pay union dues, and thank you for being consistent with all of your policies.

Maybe you will be so lucky to get one someday and need the benefits of marijuana to give you an appetite and to relieve pain. Also Walmart has proven time and time again they are a bunch of dicks with their assinine policies. My uncle who just so happens to be a very bad diabetic was employed at Walmart, until last month he had a diabetic episode and need sugar before he fell out, so he goes just minutes before his scheduled break to the snack bar for juice and is fired because of it! I don’t know about Walmart but I would like for my employees that have such illnesses when they feel like something is wrong take care of themselves, or less I will be facing a lawsuit when one falls out on the job and gets hurt. But see Walmart doesn’t give a fuck, not about you the consumer and absolutely not all about you the employee. And no Judith I will not spend another dollar in that dump.
I wish I could get medical mj for my bipolar disorder. My employer, The Bank of New York Mellon fired me because of my disorder. I engaged in the same activities as my coworkers but was labeled a direct threat. What made this situation worse, BNY Mellon lied about the circumstances.

F*ck Walmart! They do not care about people or society. That man should not be made into a point or a policy. He is sick. He is making himself feel better, without harming anyone else in the process. It’s natural, to boot! My father had a very rare form of brain cancer and I do believe that it would have helped his suffering tremendously, had it been legal.
I choose not to shop at WalMart for very many reasons, this will only add to it. People, do your small businesses and community some good, and buy local instead of big-chain. This is yet another reason why I don’t shop at WalMart.

Judith does not know what she is talking about. I worked for Wal-Mart for almost 10 years at low pay and after I was injured/disabled was treated like dirt. I don’t know about the state of Michigan, but I was able to carry my medical insurance under the cobra act for 18 months after leaving Wal-Mart. I was
a stock holder and was 100% vested and lived off this money to pay the bills and have insurance. If I had not been disabled because of a racist store manager and his racist friends, I would have a large profit sharing account and about 250-300,000 in stocks by this time. But, I lost everything I had and saved because of they racism at Wal-mart and now President Obama says that people drawing social security disability and paying for medicare are getting welfare and entitlements. I can’t win. Plus, they would not let me draw my short term or long term disabilty
insurance that I paid for nearly ten years. I actually think WalMart will win this, although I think it is absolutely ridiculous. I have done many presentations on WalMarts unethical acts so this doesnt surprise me, but I wish Joe Casias a painless life and a large sum of cash from WalMarts pockets.
Walmart says: “We believe our policy complies with the law.”
Then the law needs to be changed. Another reason for all patriotic Americans to work as hard as we can to keep conservatives from having control over our government, our laws and ourselves.
