Raid update: Brutal tactics employed in San Diego D.A.’s war on sick
According to the San Diego County District Attorney’s Office — the agency that led yesterday’s multi-jurisdictional raids on local medical marijuana providers — warrants were served at 14 dispensing collectives and six associated residences. So far, 23 people have been arrested in connection with the raided facilities.
The D.A.’s press release attempts to justify the actions using an extremely narrow interpretation of state law relating to the role of a “primary caregiver.” It does not address whether or not the facilities in question were operating as “collectives” – a more common state-legal model for dispensing medical marijuana.
One thing that’s clear about this case is that San Diego would have been better served if its leaders had moved to properly regulate medical marijuana facilities rather than resisting any effort to do so before resorting to brute force to shutter legal access to local patients.
If you’ve had any doubt that these raids are being carried out by heartless thugs, just look to the image below from video captured by San Diego’s KFMB News showing an officer manhandling a wheelchair-bound patient into the back of a patrol car. Remind me again, how is this serving the interest of public safety?

One problem is this. When laws are shaky and undefined people need to be careful and smart. Obviously warrants were issued because there was enough evidence of criminal activity. If the people involved were following the law, they would not have problems. Screaming, yelling, and fighting with the cops creates problems. After all, the cops don’t know the situation, they are just doing what the lawyers and DA tell them to do. Go peacefully, then show you didn’t break the law. Also, judges and DA’s have discretionary power. Being belligerent and confrontational will only get you into more trouble and rule out any leniency or benefit of doubts. If you are breaking the law, you need to realize that in this country people don’t have the right to do whatever they want. You can’t break the law just because you don’t agree with it. IF you do break the law, you need to accept responsibility for the consequences. It pisses me off when people get angry at cops (in example) for giving speeding tickets. The driver knew the law, chose to break it…why should the cop be blamed?

I saw the news report today of the raids against local medical marijuana clinics, and I was most disturbed by the way the police mishandled the gentleman in the wheelchair. Also, the state of California has legalized medical marijuana – why would YOU be involved, other than to push a personal agenda without regard for the wishes of the voters of this state and the patients who need this type of compassionate care? I am deeply disappointed in you.
You won’t be getting my vote next time around unless you re-examine the legalities and the morality of this situation, and change your mind to support the state law.

From what I’ve seen, they raided them for charging too much for there product. It does not cost $700,000 to make bud for 6 months.
It dont cost $20 to $35 a gram to break even and stay non profit. If the price per gram goes down then people can buy more grams.
More grams = More taxes
In New Mexico the law says you must be NON profit.
You can buy bud in NM for $6 – $13 a gram.

San Diego Pig Department. Still haven’t evolved. They busted me in 1974 for empty pipes. When I went to court, they brought out six ounces that they say was mine, and every previously empty pipe had been filled with weed and scotch taped over. Who doesn’t drive around with all their pipes full and scotch tape over them?! The SDPD is horribly corrupt, and the only reason I’m glad I moved away.

Since I can never recommend (and will never recommend) violence, then I seriously worry that our government will continue to persecute and prosecute us, beat us and jail us, and yes, kill us.

#26: I’m not disputing what you wrote however, San Diego is one of the Most Expensive places to live now. Rent is sky high still and no doubt business places rent is sky high.
The town of Hillcrest, where the reporter was at is not far from where I grew up. It’s a very clean area with a great deal of renovation done on the business buildings and an overall sprucing up of the area that was falling into disrepair. They’ve really made it a nice area to want to go to anymore.
#23: Does that ballot measure take the frakking Federal Government out of the picture? I’d guess no, so it will do little good until the Feds END the war on people, oh excuse me, the “moral” war on drugs.
Side note: Was watching our local Utah news station the other evening and instead of ‘War on Drugs’ they had ‘War Against Drugs’ splashed on the television screen. Don’t even know what that was all about either as I got in at the tail end of the story.

There are no statements regarding recieving permission by the Federal government for the people of California to legalize marijuana in this particular initiative that has been validated by Califorina’s secertary of state. Still, as you stated, we can get hasseled by the federal government. But at least marijuana has the chance to be legalized somewhere in the United States which is a huge political statement coming from the most populated state in the union. It would draw the line in the sand with state and federal laws. Why MPP and NORML and others like it haven’t been running headlines on this to get people to sign this petition, and get this valid intitiave on the ballot for the people of california to vote on it?

My vision is the following: The harder they pound on you and me and our neighbors and our children’s friends’ parents and all that…the harder they slam that fist like the old Russian “hammer” coming down, the louder the people will cry out for mercy. And the louder the cry, the farther it will be heard. California is so far away from Washington D.C. but they HAVE to listen if there is a true joint effort when the 13 states (colonies? what a funny number that is!) all reunite as they did back then and THEN go to congress.
Perhaps the answer is not in fighting the state now. Now it’s time to go to congress and demand that the taxes WE ALL PAY are not paying for this.

The MPP should get more information about the raid before sending out these email notices. It makes the MPP look irresponsible and less credible.
The DA said they were only raiding those businesses that were making large profits (illegal!) and had large numbers of complaints. She specifically said they would not prosecute anyone that was legitimately and legally growing and using marijuana.
There are still plenty of dispensaries in San Diego. If the MPP wants credibility, you need to encourage those dispensaries that are legitimate, and discourage illegitimate dispensaries.

What a sad story. It has been set in place for a long time. A state legalizes a plant for people to use ,but it remands illegal at the federal level. Now the stage has been set for the true underminding of the people who fought and died for this plant to be legal. People will now go to there local doctor and ask for a new medicine that is herbal and has some promise both for helping with pain, diseases, etc. A safer choice that has no know deaths from consumption. Now once you gotten your prescribed medicine you have just broken the law and are a criminal. This is what we voted for? A very sad thing but the worst part of this is the fact it happeneds everyday.

OK, so now that people are really trying to understand the true and absolute meaning behind the drug war, such as the industry. HBO has Marijuana Inc. and they showed the other day the breakdown of Marijuana industry. You break law, they incarcerate, you pay to be either in jail or on probation, if jail, you work for .43 cents an hour, and then you get out of jail. You and I are mearly pawns in this country. And I am going to go out on a limb here and say something, “I think they have won the war on drugs”. I put it in quotations because you can quote me on that when I am standing in front of D.C.

If 5 people out of 20 do not smoke cause they are being active in politcs, and then another 4 dont smoke cause of the DARE programs. Then, the last one, if 3 people DONT smoke cause they are either in Prison, Jail, on Parole, or even pissing on Probation, that is 12 out of 20 not smoking marijuana. They won.

On Marijuana Inc, one of the dispenseries busted in the raid, told HBO that they do pay taxes on their money made. Both state and FEDERAL. when asked how much he paid last year, he told them simply, I paid the state of california 14% of my income *200,000* and paid the USA 30% *roughly 400,000* so let me ask you something….how much did that raid cost? I bet somewhere around 400,000. SO, once again,

Gov Rick Perry of Texas is putting Rangers on the border with Mexico to deal with drug violence bc he said the Feds have not done enough to stop it and Gov Perry is absolutlely right. However what we need to deal with is the problem at it’s source: money (70%) made by cartels selling marijuana (dirt schwag filled with poison). We need to deal with this problem in a wise and profitable way that will create jobs and stimulate the economy, not stretching leo and military resources on a battle we can win with an economic weapon. I am a 26 year old citizen of Missouri that pays taxes every year and has never been in any trouble with law enforcement officials, other than a few speeding tickets. I have 4 herniated discs in my back that I deal with since I live paycheck to paycheck and connot affotd surgery or to be out of work while recovering from the surgery. I have carpel tunnel in both wrists that I have delt with for 10 years (my hands have went numb 4 times while I wrote this). I have had 4 knee surgeries on my right knee and need surgery on my left, but once again, I cannot afford it. I do go to the BLA BLA BLA in BLA Missouri where the doctors there have tried many exploratory ways to heal my back without invasive surgery, but with little to no success. I have been prescribed a narcotic called Percocet, in which I take 120 a month to help me deal with the pain. These pills really do not work, they just make my stomach hurt, give me constipation, and really they do not take my pain away, just make me feel weird. I will soon be asking my doctor for an increase in the amount of pills per month because I have slowly built up a tolerance to them. Marijuana has been proven to be medically beneficial and many tests have been done to debunk the many lies that were made up in the 1930′s to make marijuana illegal. It is not a gateway drug. It is not addictive. It is less likely to harm you than that of an asprin, as a matter of fact, no person has ever directly died from marijuana use, as of the oppisite with asprin, where over 10000 people die annually from asprin use. Marijuana was originally made illegal because the tree industry was in limbo because hemp is a more beneficial plant than tree (1 acre of hemp does the same as 40 acres of trees). Another reason it was made illegal is race. Blacks were using marijuana and white adults didnt want their children going into black neighborhoods to buy marijuana or smoke it.
INSERT NAME, I hope that you have done your homework and learned the facts behind marijuana and its TRUE effects on people and communities. It just sickens me that this is still going on. $700,000 worth of marijuana and products in 6 months…. lets do the math…. 700,000/6months=116,666 now lets say they are closed on all weekends so 20 work days in a month 116,666/20= 5833 per day assuming a 5 day work week…. lets say they have an 8 hour day on each of those days 5833/8= 729. How is it so hard to think that these dispensaries are selling $729 worth of products in an hour? especially when your talking about products that can cost more than $200 for one ounce…. more than $350 for good stuff….. so 2-4 customers per hour buying an ounce? thats too much business? think about it….10-15 customers a day buying different amounts would equate to that….. its bullshit and we all know it…. they are going to punish companies that do good business? wow…. boggles the mind…. now my numbers as far as price are not exact, but im sure im in the ballpark…. someone please let me know if im off by a lot…. something is fishy here

On Wednesday, September 9th Secertary of State State Debra Bowen announced that proponents must collect signatures of 433,971 registered voters by Feb. 5 2010 in order for ballot measure 09-022 The Tax, Regulate and Control Cannabis Act of 2010 to qualify for the ballot.
Where’s the news Headline MPP? Too busy counting those donation dollars and looking at all the tits and ass at the Playboy Mansion? And I wonder where my donation dollare are going…

To answer your question, MPP is not promoting any of the three initiatives on our home page because we do not yet know which of them – if any – will end up qualifying for the ballot. We are in touch with initiative proponents and along with every other major drug policy reform organization working in California, have expressed grave concern that 2010 is not the year to rush into an extremely costly initiative campaign. One reason for our word of caution is that polling data shows an initiative in 2010 would not garner as much voter-support as it would in a Presidential election year like 2012.
If and when one of the three pending initiatives does end up making it to the ballot, we will be posting more significant information about it on our site. Thanks again for your interest in reforming California’s marijuana laws.

I understand if you don’t want to endorse any of them, but I think it’s only fair to at least notify or discuss the initiatives to the visitors of your website and it’s donors. To think you guys even made a commercial to Tax & Regulate yet don’t want to endorse any of the 3 or even present all 3 of the initiatives??
Keeping a lid on it will not help any of the 3 initiatives and will only leave them struggling to get the word out and time is running out. I’d rather have at least one of them make the ballot instead of none of them.

Our concern is not with garnering media attention. A marijuana-related initiative on the state ballot will receive *loads* of attention in any year. This is about strategy and polling data. We know that younger and more progressive voters will naturally turn out in higher numbers in 2012, regardless of anything we do.
Waiting until 2012 will also allow more time to debate the issue in Sacramento, build a coalition of supporters, and push public opinion higher. We should be close to 60% before starting an initiative campaign. We’re getting close but we’re not there yet.
An effective initiative campaign in California will cost our movement upwards of $10 million (the biggest project we’ve ever embarked upon) — that’s why it’s critical we ensure we’re going into a campaign with a good shot of winning.
I agree that we need to “strike while the iron is hot” but I think we need to take a more methodical, strategic approach that may amount to at a three-year plan.
Now is our time, let’s do this right.

However, I don’t agree with the reasoning about waiting for younger voters. I grew up in the sixties and seventies. Pot was a part of our culture too. Since that time, I have lived long enough to see my kids try it (on their own). Only one kid still uses, to my knowledge, and since I openly endorse legalization (as of this year), there is no reason for them to lie to me. There are millions like me.
Most of my friends, also part of the “older crowd”, feel the same way and share similar memories. Most are successful in life. I for one have always abhorred the hypocrisy. It wasn’t until this past year though that I discovered the many medical uses, like the cure for cancer espoused by people like Rick Simpson, and had my eyes opened to the real hypocrisy of the government. Now I believe my kid when he says it helps his condition better than the prescription drugs ever did. He is Bi-polar.
Even the die hard opponents I have come across change their minds when I explain about beating cancer through a new method which is being kept from public knowledge in the mainstream media. I’m talking “bible thumping” conservatives changing their views mind you. This is no mild thing to see that happen, in Texas no less.
Outright legalization is of course the eventual goal, if no other reason than to end hypocrisy, but the medical issues are the tipping point. This cause alone will sway voters. Don’t wait for a generation to grow up that never understood Woodstock. Go ahead and pick an initiative and push for it by getting the word out. This is what I’m waiting for and what my wallet will support, not playboy mansion parties.

Had a horrible argument with my Chiropractor yesterday and I’m ashamed of myself today for not having better control. I’ve learned a valuable lesson. He was bragging about helping the Sheriff’s department pull up 3,300 cannabis plants in our county.
I lost it, really the dumbest thing I could have done. I got all the facts outs but used the F word too many times.
And this Chiropractor has said to me repeatedly that he thinks marijuana should be legal.

To me this looks like a last ditch effort to gain some footing for prohbition. The cops and DAs all know its comming to an end, they are pushing back trying to gain support for prohibition, to try and show there are problems with medical marijuana law and simple they are scared that its all over.
You have many votes comming up about marijuana in CA and they have to try something and I dont think it will stop there. They are scared and are acting like a 3yr old that is having a breakdown because you wont let them watch SpongBob.
These are growing pains of the movment and the real test will be how the public and the court cases go? If the public calls foul and the courts agree, well then this is it, they will be stopped from doing this again. However if they gain support and the courts decide to run these places through the ringer we could see a major push back from all government.
They know dam well that prohibition is on its death bed and they are scared. They are going to pull this everywhere when other states start passing more and more laws. We will see this in every state but thats good because we are at least seeing it and talking about marijuana and getting laws passed.
But we have to keep fighting even when laws are in place so we can stop this RAID crap from ever happening. CA has really pushed this movment across this nation and these last efforts of police and government, just proves that their “War” is a failure. There are no statements regarding recieving permission by the Federal government for the people of California to legalize marijuana in this particular initiative that has been validated by Califorina’s secertary of state. Still, as you stated, we can get hasseled by the federal government. But at least marijuana has the chance to be legalized somewhere in the United States which is a huge political statement coming from the most populated state in the union. It would draw the line in the sand with state and federal laws. Why MPP and NORML and others like it haven’t been running headlines on this to get people to sign this petition, and get this valid intitiave on the ballot for the people of california to vote on it?
real weak Aaron. your guys influence can help drive people to get the http://www.californiacannabisinitiative.org/ which legalizes both Hemp & Cannabis, is the superior initiative. how is this initiative costly when it is volunteer based?

Thanks for your comment, Lea. To answer your question, MPP is not promoting any of the three initiatives on our home page because we do not yet know which of them – if any – will end up qualifying for the ballot. We are in touch with initiative proponents and along with every other major drug policy reform organization working in California, have expressed grave concern that 2010 is not the year to rush into an extremely costly initiative campaign. One reason for our word of caution is that polling data shows an initiative in 2010 would not garner as much voter-support as it would in a Presidential election year like 2012.
If and when one of the three pending initiatives does end up making it to the ballot, we will be posting more significant information about it on our site. Thanks again for your interest in reforming California’s marijuana laws.
