Los Angeles District Attorney Vows to Assist Drug Cartels and Local Rapists

The Los Angeles Times reports today that L.A. District Attorney Steve Cooley thinks California’s medical marijuana collectives are breaking state law. Cooley vowed to prosecute all the medical marijuana facilities in his county, estimated to have nearly 1,000 medical marijuana collectives. Cooley can say that these collectives are illegal all he wants, but that doesn’t make it true.

Last year, the state’s attorney general issued a legal opinion that clearly stated that “a properly organized and operated collective or cooperative that dispenses medical marijuana through a storefront may be lawful under California law.” Maybe Cooley didn’t get the memo.

If Cooley is somehow successful in eliminating L.A.’s medical marijuana facilities, the effect would be disastrous for patients forced to find their medicine in the underground market and would be a boon to the violent drug cartels that often supply that market. Voters in Los Angeles — who overwhelmingly support medical marijuana — are probably scratching their heads trying to figure out why their district attorney wants to enrich criminal drug dealers at the expense of patients.

Cooley’s priorities are dangerously misguided. Los Angeles County maintains a backlog of more than 3,000 untested rape kits (evidence collected from a sexual assault). This means that these rapes have been reported but are still not being investigated due to limited resources. I guess Cooley thinks law enforcement efforts would be better spent terrorizing seriously ill patients and the people who provide their legal medicine than solving violent crimes like sexual assault.

Wow another state official out of his mind. I guess for every person that recognizes the needs for medicinal marijuana there’s at least 10 a-holes like this one that will do everything in their power to stop the momentum medicinal marijuana has gained over the last several years.
I dont live in Cali, but i hope everyone who does, rememberes this when they go to a voting both next election.
People like this should have never been appointed or elected to power, but it’s never too late to fix that.

Maybe Walmart is applying for a Marijuana distributors licence as we speak in advance of the California ballot initiative for Nov 2010 and using it’s lobying might to squeeze all the mom and pop establishments ahead of time due to the inevitability of the reform law passing.

It just seems that ever since the inititive was alowed to be a line item on the Nov 2010 ballot the state and local law gustapo has ratcheted up the propaganda and just blatant attack on The Movement. I see it as a last ditch effort of a scared faction.

And the other question would be who’s above this guy, that’s the one that didn’t get the memo either. I hope heads roll in the DA’s office.

This is simply backlash for all the growing support for medical and recreational use of marijuana. They see their Prohibitiion failing, they see activists getting louder and they are seeing a growing public awarness about marijuana in general. They are crapping themselves because of it.

Simply put they are scared, they know its all comming to an end. This is a last dich effort of a minor few, Cavemen as I call them, there will be more Cavemen and more backlash as this movment spreads across the nation, but we have to keep fighting. Just like real Cavemen they will have to evolve or they will die out.

This D.A. is ruining his future. Next election there will be a new Gov. in Cal. The mayor of Frisco is runnning for the office of Gov. and his platform is to tax and regulate the sale of cannabis. If Arnold wants to stay in office he may want to agree and say so in public, soon. The legalization of cannabis will only boost the economy and keep billions of dollers in the hands of Americans instead of the drug cartels. There is so many benefits to legalize and the time is comming when elections will be won by the pro cannabis voters. We one day will out number all other voters groups. the federal policy is messing with the states. erase the federal restrictions, and then it’ll be up to states, then counties.

Cooley was just on KABC 780AM in LA saying a lot of the same: the marijuana sold by collectives has 1500 times what a safe insecticide level is considered, it’s grown by drug cartels in Mexico and it’s destroying communities.

He’s citing a law stating that over the counter sales of marijuana for profit are illegal and seemed to suggest that the non-profit co-op model is less offensive. When an advocate’s argument was brought up, Cooley said he would deal with it in court.

He also mentioned “voluntary closings” of dispensaries that, with his announcement, will recognize that they are illegal and close.

I believe there needs to be some regulation and a business license issued, taxes paid, etc. but this is the result of the LA City Council being asleep at the wheel for two years after their moratorium in 2007. From what I understand, the LA City Council left a “hardship clause” in place and never reviewed any applications to open dispensaries from 2007 to August 2009 – they rejected 85 applications.

That’s how we ended up with 800 plus dispensaries.

I hope some of the arguments I see here, like county law vs. state law vs. fed law might push the issue towards legalization. Cooley is going to waste a lot of tax payer money fixing a problem created by the LA City Council, also tax payer funded.

I just hope we don’t need any tax dollars to pay for celebrity funerals.

Mr. Smith, I don’t think that your tone, especially in the title, is conducive to MPP’s ideals. That sort of speech that only has a tinge of truth if you connect enough dots sounds like something Calvina Fay would say. I don’t doubt that there are some dispensaries and or collectives that get a little excited being able to legally grow and dispense cannabis and over step their lawful abilities. I mean it would be hard to not grow just one more plant or smoke some for yourself or just sell a little to pay the rent, etc. Don’t want to sound like someone that is against MPP or medical MJ, but if the rules are not followed to the ‘t’ there will only be more instances of medical MJ neglect to encourage that to be taken away, and medical MJ is the only foot we are standing on right now.

This fools name should be steve uncooley. he is just the type of professional politician that term limits were made for. its jerks like this that talk out of side of there mouth, say anything to get elected,climb into bed with anyone who has the money to further his own ends .even an uncool fool like uncooley simply because of his age has had personal experience with pot , medical or otherwise he has a friend (assuming he has a friend) or family member (probably mom) or perhaps a turn at the bong himself (although I’m sure he didn’t do it right since he seems to blow everything out his ass)in any case if this guy can’t see for himself that wasting his valuable time and our tax payer money putting law abiding adults in JAIL for using a substance that has never killed or harmed anyone(if you believe the AMA or JAMA that is )than it should be clear to the rest of us he not smart enough to do his job .The truth is I agree with Uncooley that weed is not a medical issue, its a civil rights issue. And I for one am tired of being treated like a criminal by con-men like this who should be protecting us,instead of playing his fiddle while our city burns.

The laws against marijuana are illegal, immoral, unconstitutional, and un-Biblical. I’ve often referred to those prohibitionists trying to get us to flagrantly violate the truth this plant is on our planet for a very good reason as belonging to a religion, the Religion (of Hate) Against Marijuana.

MPP, NORML, LEAP, etc… are not standing on one foot. They have dug deeply and are standing on both feet, on the truth: marijuana is medicine, marijuana is safer than alcohol, marijuana does not deserve to be illegally, immorally, unconstitutionally, and un-Biblically called illegal.

How much better would the world (and U.S.) be if these unnatural laws of prohibition were gone? To begin, we would not be wasting over $100 billion per year fighting these dumb wars, sending kids to their deaths, incarcerating people who do not deserve to be locked up, people could have access to an all-natural medicine at an un-inflated price, and like Aaron points out, cops could actually work to locate people who prey on society.

Here is a brief write-up with links to a Human Rights Watch report. Also, according to Kathleen Parker (link in above post), there’s more like 400,000 “rape kits” sitting around untested in the U.S. Insane!

Ben, I’m all for towing the line as a team-player, and I have no inside info into MPP’s strategies. But I think the reason it’s taken so long to end this madness is that “we” have been playing with kid gloves, while the prohibitionists have been using batons, guns, prisons, evil “laws,” and lies.

According to the article that Aaron links to, about LA cutting their backlog in half. They still note that it won’t be until the middle of 2011 when the finally catch up! “Gee ma’am, I hope you don’t mind waiting another 2 years while your rapist runs free.” We need to end this prohibition NOW so we can put our resources to good use instead of flushing them down the toilet! Yes, prohibition is A COMPLETE WASTE!

Personally I say smash California’s debt to pieces by ending this un-Godly prohibition against Marijuana (and other plants). Use the money wisely instead.

I totally agree with Aaron’s characterization (and others’) that their priorities are misguided and (too) many in law enforcement go after easy targets. Ironically this makes them just like the rapists.

Why spend all sorts of time and effort hunting down rapists when there are people in wheel chairs other easy pickin’s? Don’t rapists generally go after easy victims than chicks who look like they know karate or will knee them in the nuts?

Ben and Drew: Thanks for your thoughtful comments. I admit that the nature of my title is a little sensational. However, it is true.

Just one day before D.A. Cooley made his announcement, the a front-page story in the Washington Post explained that domestic marijuana producers — including medical marijuana — are cutting into the profits of dangerous Mexican drug cartels. It’s absolutely insane for the D.A. to try to reverse that trend by handing L.A.’s huge medical marijuana market over to criminals.

And, as for helping rapists, it is clear that law enforcement everywhere is operating on a tight, finite budget. Any time spent busting marijuana consumers or medical marijuana facilities is time that could be spent elsewhere. For example, the FBI reports that in 2007, more than 66,000 violent crimes were reported in California but went unsolved. I can’t help but wonder how much smaller that number would be if we didn’t arrest 74,000 people for marijuana (mostly possession) that same year.

Ah, those people are just so %^&*ed up. They must be doing it for political reasons, i.e. selfish efforts to grandstand and promote their own careers. The only reason they can do it is because MM’s legal standing is precarious and vulnerable. They clearly don’t care a single iota for freedom or justice.

One might even say they are typical lawyers. The law is in fact so arbitrary and so often unjust, that people who really do care for those values tend to be automatically selected out of the profession. All are highly trained to game the law, to the advantage of whomever pays best, or for themselves. These guys want to make a big splash claiming to be tough on crime, the problem being that MM dispensaries hardly qualify as dangerous crime, or any crime at all beyond regulatory technicalities. Why aren’t they going after real crime? These guys are like extortionists: “toe our line, however absurd, or go to jail.” They make me sick.

I would feel differently if they were actually doing some good. But actually, all they are doing is attacking something good and decent, purely for their own personal benefit, and to hell with whomever gets hurt. They are SUCH a much more harmful element in our society that any dope smoker ever was.

In the mean time, we must not forget, the county will pay for 1000 unjust and difficult prosecutions? That alone will cost 10s if not 100s of millions of dollars. Who out there thinks we need that?

I think this is a good thing, Theres no way anyone is going to stop medical canabis, however there efforts to stop it will help us in the end. We have the state law covered, but the federal law is still in are way. There is no need for them to change the federal law unless they are forced to.

The act of dumb people seeing the need to arrest us under federal law for using cannabis will, in the end, force the hands of lawmakers to change to federal law.

If no one is arrested under federal laws then there would be no need to change them.

After the President won the Nobel Peace Prize he tweeted: “Humbled”… I was able to immediately respond now that I have set up a twitter account to let him know he show declare PEACE on marijuana users…. Yesterday he asked for help setting up call parties to fight for Healthcare reform (he wants to generate 100,000 calls to congress)… I asked if I could set one up to help fight for REFORM in our Marijuana laws…

I haven’t heard back on either tweet, and frankly don’t expect to. However, if he received more responses every time he (or his staffers) tweeted, he would see the support for the issue. IF you haven’t done so already… go set yourself up with a twitter account and put a regular bug in our government’s ear!!!

As you know, the city of Los Angeles has a backlog of over 3,000 untested rape kits and is facing myriad law enforcement and budgetary cuts, as well as overflowing prisons! Yet you put medicinal marijuana at the forefront of eradication and enforcement. Why?
Can you explain the methodology, which allows you to utilize tax payer funds in such an egregious and inappropriate manner?

Ben #52 – Fox News isn’t all that bad. We all have to take our delivered news, on whatever channel with a grain of salt, sift through the false and the truth and come to our own conclusion.

With that said, I’m not a Rush fan nor a Beck fan. Beck has come up with some very interesting and thought provoking shows though, and no I don’t watch him every day. Rush is a tad bit too aggressive for me and I don’t care for the sound of his voice so the only time I hear him is when someone else is interviewing him.
I went to that site you posted and while it’s interesting, after a quick review, I didn’t run across anything that addressed the war on drugs. Perhaps you can point me in the right direction at that site. If there’s nothing there covering Obummer’s position on this ridiculous war on drugs, particularly marijuana, then I have no use for it.
It has come to a point in my life where 99% of my acquaintances that don’t support the end of Prohibition are no longer valid or important. I’ve little time for them and their stupidity.

Way to go lo9an, keep his feet to the fire for as long as you can stomach it.

I dont watch the news. I read my books and I listen to people in my area that are talking about revolutions. Our freedom is at stake and the government is killing American citizens. But dont worry, I am sure they will take pity on you. Once they stop civil disobedience on gun control, what will be next? They will make you pay for your gardens, make you pay taxes on your pets? Big Brother is here folks, whether you wanna admit to it or not. As for I, I will move to another country if I need to.
As for the statement about my dad joining the army in Vietnam, he sits in amazement at what this country has become. What would George Washington, Thomas Adams, and the rest of our founding fathers think of this country? They left English territories because they were being opressed, taxed without representation, and religious freedoms. I always say that history repeats itself. I just hope I am wrong because I dont want to fight. I wanna just work my 40 hour work week, smoke my weed when I want to in my own home, and retire cruising around the country in an RV. Not much to ask. But I dont know if there will be a country to cruise. Hell, I dont even know if Ill be able to afford an RV. And yes a computer and internet is a nessessity in my house. I have a 14 yr old that has computer classes and she has to research topics for schoool. But believe me, I drive a 1983 car and I have no spending money left from week to week. This is cause I want to give my step daughter things that I didnt have. SO I am sorry about the rants, but I just dont see why I, a very productive member of society, just cannot be free. I dont hurt anyone. Hell, Ive never even been in a fist fight.

JJ: I came here just to see if you had commented. If you hadn’t I was going to say ‘hi JJ’ and that I really do understand. It’s obvious that you love the real American and it’s obvious that you’re a compassionate person.
We all rant, just remember that you do have friends here.
I too am a productive member of society and it hurts my heart that the g’ment has become so corrupt.

So let’s focus our attention on righting the wrong of Prohibition and deal with the other sheyit when it happens. Is that doable?

And JJ: I can well understand your dilemma with all the meds you’re forced to take because of Prohibition. I cannot take pharmaceuticals, they make me throw up. The only one I can barely tolerate is Allegra, a prescription allergy medicine, and I have to be careful to remember that even it affects me in an adverse manner. That adverse manner is: It makes me angry. So I rarely take it, and when I do I have to remind myself what it does to me.

The actions of the LA DA will get the courts involved, which will help to sort out the law-abiding operations from the merely opportunistic. Collectives (and other operations?) that follow the California law will probably come out looking fine, and the non-legal profiteers will probably be put out of business. In the long run, this will help clarify the law and make it more difficult for prohibitionists go after the legitimate operations.
One step at a time, little by little.

Why are pharmacies (which also provide meds to sick people) NOT forced to work as non-profit dispesaries ? Why only the med cannabis? I say put med cannabis in pharmacies and treat it as every other medicine or stop the gouging by pharmaceutical companies by making them operate under the same rules as the cannabis dispensaries.

That isn’t what the DA actually said, and you know it. That may be the result, but dishonesty and misrepresentation will NOT win the war on drugs. truth on the other hand can and eventually will.

Don’t agree guys that Pharmacies should have control of Medical Marijuana. They’d ruin it, absolutely ruin it.
We need to keep the dispensaries as close to free spirit as we can. And not for profit doesn’t mean there’s no profit.

I keep hearing about all the crime that will be taken care of “after they stop wasting all their time busting cannabis consumers” Personally, I believe that a lot of drug warriors will look for other work after prohibition ends. Looks like LA County is going to pick up where the Obama administration left off. A win-win for government, Obama admin adheres to its campaign promise of stopping “FEDERAL” raids and LA County with a little extra “War on Drugs” money I’d bet, gets help with it’s budget shortfall.

As for the rape kit backlog, my take is that the Federal Government, using the “War on Drugs” money, helps finance the LA County Narcotics department as long as the County keeps arresting marijuana users at a high rate. The Sexual Crimes department most likely receives its funding from the State which we all know doesn’t have enough to balance it’s own budget. The Federal Gov’t sees the War on Drugs as a bigger problem than rape because there is no rape victim lobbyists that have any money to speak of unlike all the lobbyists for the “War on Drugs” industry. When the daughters and wives of the politicians begin to get raped, those kits will be flying off the shelves.
