CA Police Chief Attacks State Law, Warns Medical Marijuana Dispensaries

Here’s one for the “Cops Unclear On the Concept” file: The Record-Searchlight in Redding, California is reporting that the town’s police chief, Peter Hansen, has sent a warning letter to local medical marijuana dispensing collectives. Hansen’s letter warns dispensary operators that they are in violation of federal law, that “federal law takes precedence over State law,” and, “Violation of this law is a felony crime that carries with it a penalty of up to 20 years in prison.”

While the chief has every right to dislike California’s medical marijuana law, it is his job to enforce state law, not attack it. That’s something the courts have made unmistakably clear, most notably in a case known as Garden Grove v. Superior Court. In that case, city police had improperly seized medical marijuana from patient Felix Kha, and then insisted they couldn’t return his medicine to him because federal law takes precedence over state law. The state appellate court ordered the return of Kha’s marijuana, stating, “[I]t is not the job of the local police to enforce the federal drug laws as such.”

Memo to Chief Hansen: Is there something about the phrase, “it is not the job of the local police to enforce the federal drug laws” that’s hard for you to comprehend? Is Redding so completely free of robberies, rapes, murders, auto thefts, and other actual crimes that you have nothing else better to do?

Police need to stop fighting all this an start working together not to “protect” the people but do to what is in the best interest of the state. i believe the cops r getting paid off by DEA to do all this simply because i can think of no other motive besides hurting inosent people… them F****ers

i can’t believe it, my home town made mpp news… the record searchlight all summer has run cannabis stories with a blog comment post at the bottom. this is what ive been posting about here all summer. it is like the 50’s here in my town. police can do anything they want unchecked including threaten local businesses. with advent of legal enterprise related to cannabis we the people of redding should march and demand freedom of commerce with out tyranny from from our local police force of all people. is it any wonder why we see the police as just bullies any more? get up! stand up for you rights!

Ok, why can’t we see the DEA’s raids on MM collectives/despencaries as what they are. A violation of STATE’S RIGHTS. Violation of states rights is what sparked the civil war… and when CA legalizes marijuana in the November vote, and I have no doubt that they will, the DEA will swarm that state. It will be in total violation of states rights. Now, I’m not saying that slavery was a good thing, but still it was a violation of states rights. It took an amendment or 3 to the constitution to abolish slavery. It took an amendment to the constitution to prohibit alcohol…which was later repealed….where is the amendment prohibiting marijuana? Since there is none, the federal government is, as I said, violating state’s rights. And as CA begins to prosper following Marijuana’s legalization, others will quickly follow. Continued federal involvement will inevitably spark another civil war. This time, the rebelling side will have much stronger support. Unfortunately, though, the weaponry has changed, and it will be a very ugly, yet short lived battle….most likely resulting in total in-sovereignty to the current federal government, and, hopefully, the start of a new, more free, America.

As Americans, we have the ability to change our Federal government every 4 years (6 if you count the Senate), and our state and local governments at about the same time frame. Talking about violence isn’t going to solve this problem. Working in campaigns for good candidates, building public support for a win-win solution, those are the keys to progress.

Maybe we should all let this CA LAW ENFORCEMENT OFFICER know HE is violating STATE LAW and breaking the oath he took to protect the PEOPLE OF THE STATE OF CA! He is also violating medical marijuana patients rights under the CA State law and just about every court decision that has been published, sides with the patient over LEO’s abusive harassment tactics. One court even went so far as to spell it out for local LEO’s when they published:

“Seriously ill patients certainly should not be required to risk criminal penalties and the stress and expense of a criminal trial in order to assert their rights.”

AND

“Thus, if plaintiff can show that he had a legal right to possess the marijuana in question, and that his rights were violated, he may bring his action based on generally applicable legal principles.”

“Withholding small amounts of marijuana from people like Kha who are qualified patients under the [Act] would frustrate the will of the people to ensure such patients have the right to obtain and use marijuana without fear of criminal prosecution or sanction.”

There should be a law on the books that states that State Law Officers can not arrest you fro Federal Crimes and that Federal agents can’t arrest you for State Crimes…

Seems to me that if a State Law Officer suspects an individual of violating Federal Law that their responsibility should be to notify Federal Agents. Furthermore, as a State Law Enforcement Official they should be protecting their citizens and ENFORCING the laws of the STATE. By not enforcing State law those law enforcement officials are breaking their oath of office and have grounds for termination.

Does someone have the official “Oath of Office” given to each State Law Enforcement Official in the State of California? Acting outside of this oath is either a neglect of duties (not enforcing State Law) or it is a case of Abuse of Power (if they are enforcing Federal Laws). Either way… a lawsuit should be filed!!!

Redding has much bigger and dangerous problems to deal with than busting medicinal users of marijuana. Redding has their “dirty little secret.” Redding is given money by the feds for every pedophile, child molester, child rapist they ALLOW in their city.

It’s not the potheads that you need to worry about-all y’all up there in Shasta County need to start worrying about your children. If it looks like a pedophile, smells like a pedophile, acts like a pedophile… IT’S A PEDOPHILE.

Why does big brother feel so very obligated to keep sticking his big fat nose into our homes, our pocketbooks, our lungs, our cars, and the solutions we may use to treat everyday ailmets for *ourselves* ?

I bet that police chief has had a bad day on the job, had some stress, possibly some sleeplessness, maybe some depression or anxiety and decided “I think ill kick back and crack open a big old beer and drink it. ” And nobody said a word about it. What makes him so special he can use toxic chemicals if he so desires to take the edge off and the rest of us cannot use safe herbal remedies to treat ourselves? They need to come down out of la-la land and get real. Our life, our home , our body OUR CHOICE!
P.S. When was last time a doctor prescribed alcohal as a treatment for …anything?! And when was the last time this country filed for patents regarding the medicinal use of alcohalic beverages ? This whole issue stinks bigtime! Dont let the tail wag the dog!

I’m tired of reading about how progressive other states are. It doesn’t help us in Texas. Our medical bill this past year didn’t even make it out of committee. When is MPP going to mount a campaign here?

God is not happy in his heaven because…his children are dishonoring and waring over his gift of Manna as Holy Sacrament. Neither is he happy because of the prohibiton of God’s medicine. There is but one thing to say about his medicine…”IT WORKS.”

So!…we are warned of the impending results of war…”SOMEONE HAS TO LOSE.” Genesists dclar: “It’s not going to be us.”

WHAT CAN WE DO?

1. If you want to abstain…abstain under the entity Abstentio 2012. Make your abstention a vote of non-confidence.

2. If you want to boycott…boycott.

3. If you want to file a Petition Mandamus…sign it.

4. If you want to march…demonstrate your physical presence and march.

5. If you want to blog…send your post to government.

Do whatever you can do…but do it.

if the police can enforce federal laws on marijuana even tho state laws allow its use (for certain people) then why can’t the police enforce immigration laws! i feel im being discriminated on as an american i feel i have to obey each and every law and pay taxes while a select group illegal aliens can ignore laws and not pay taxes! they are illegal aliens too not illegal immigrants yet if i get cancer i cant use pot to alieviate my pain and naseua yet i have to pay my taxes so police can harass me and trample my freedom while the look the other way for foreign invaders breaking our laws everyday! only in america!

Just checked out the RPD (Redding Police Department) website, I bet if the dispensaries “collectively”offered to finance;

“The City of Redding is in the process of exploring how to construct and finance a new police facility to replace the 60-year-old building the Redding Police Department currently occupies. ”

Maybe a little federal stimulus money has been reappropriated…
